These Terms of Use govern your use of the website operated by Divine and of the digital products, software licences and support services offered through it. Visiting the site, creating an account or purchasing any product means that you have read and accepted these Terms in full. If you do not accept them, do not use the site. FIRST AND FOREMOST If you are visiting this site to gather information to use against Divine, you must leave immediately. Your use of this site constitutes your acceptance of these Terms of Use. 2. ACCEPTANCE OF TERMS AND AMENDMENTS Each time you access or use this site, you agree to be bound by these Terms of Use. Divine reserves the right to update or modify these Terms at any time at its sole discretion; changes become effective as soon as they are posted on the site. Any additional rules or guidelines that apply to specific services offered through the site are incorporated by reference into these Terms. Continuing to use the site after a change means you accept the current Terms. 3. NATURE OF THE SERVICE All site content, software and services provided by Divine are supplied "as is." Divine may, at any time and without prior notice, modify, suspend or discontinue the site or any part of its services. Divine is not liable for loss, deletion, failure to store, inaccurate delivery or improper transmission of any data or content you provide. 4. PRODUCTS AND LICENCES Divine sells software licences and digital products. What is sold is not a physical good but digital content and a licence key delivered electronically as soon as payment is confirmed. All software and digital content are the exclusive property of Divine; a purchase grants you no ownership, only a right of use limited by the conditions below. • Products are intended for personal, entertainment use only. Unless otherwise specified, each licence is granted for use on a single (1) personal computer per customer. • The system generates a unique Hardware ID based on the user's machine components (such as CPU, RAM and disk). Users may request a Hardware ID reset in order to move a licence to a different personal computer; such requests are subject to Divine's policies and approval. • The licence period starts on FIRST ACTIVATION of the product, not at the time of purchase. No time is consumed until the product is activated. • Unlimited ("Sınırsız") licences include lifetime support. Support is limited to the period during which the product concerned remains in service. • Divine reserves the right, at its sole discretion, to delete, revoke or ban any licence key if the licence is found to be sold, resold, transferred or publicly listed for sale, regardless of the platform on which it appears. • If a licence is shared with or transferred to another user, the licence will be revoked and the associated account will be permanently banned. No refund is issued in that case. 5. DELIVERY Once your payment is confirmed, your licence key is sent to the e-mail address registered to your account and is also shown in the deliveries area of your account. Delivery through either of these two channels is sufficient for delivery to be considered complete. Every product is delivered digitally; nothing is shipped physically, including products with USB in their name. On those products you run the software from your own USB stick. If no key is in stock for the product you purchased, your order is NOT cancelled; it is placed in an "awaiting stock" state and your payment is preserved. You are notified by e-mail, and once a key becomes available an authorised member of staff delivers it manually. An order awaiting stock is treated as unused until delivery takes place. You are responsible for keeping the e-mail address on your account correct and reachable. A notification that fails to arrive because of a wrong, full or unreachable mailbox does not mean delivery was not made: the key is in the deliveries area of your account in any event. 6. PAYMENT POLICY Payments are processed through a contracted payment provider. Divine does not see or store your card details. If unauthorised payments, stolen card usage or any fraud are detected, the associated account will be suspended or terminated immediately and Divine may pursue legal action. Account sharing, resale or unauthorised transfer of accounts or licences is strictly prohibited and will result in account termination. Users who initiate a chargeback or payment dispute will be permanently banned; related keys will be invalidated and future purchases blocked. Divine reserves the right to pursue legal remedies in case of chargebacks. If you have a problem, contact our support channels before opening a dispute; it is by far the faster route to a resolution. 7. REFUND POLICY (SUMMARY) All licences are final and non-refundable; once a purchase is made, refunds will not be issued. Refunds will only be considered for licences that are clearly recorded in Divine's system as unused / never activated. Divine's activation and usage logs are the sole and binding source of truth. Any refund, if granted, is entirely at Divine's discretion and is not guaranteed. Refunds may be issued as store credit rather than returned to the original payment method. AUTHENTICATION AND SECURITY Any attempt to tamper with, bypass or reverse-engineer Divine's client software or security mechanisms will result in immediate account suspension or termination and may lead to legal action. Divine reserves the right to seek damages for any such breaches. 9. DISCLAIMER OF WARRANTIES You use the site and its services at your own risk. Divine provides all services "as is" and disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose and non-infringement. 10. RESERVATION OF RIGHTS Divine retains all intellectual property rights in the site, its content, products and services, including copyrights, trademarks, patents and trade secrets. No rights or licences are granted to use Divine's intellectual property for commercial purposes without prior written permission. 11. RULES OF CONDUCT AND PROHIBITED CONTENT Users must read and comply with the community rules and follow instructions from the Divine team. Maintain a friendly and respectful tone. The following content and behaviours are strictly prohibited: • Spam, excessively short, repeating or meaningless posts. • Off-topic posts. • Advertising or promotion of other sites, hacks or forums. • Distribution or facilitation of malware (stealers, trojans, RATs or any malicious software). • Content that is criminal, pornographic or harmful to minors. • Racist, defamatory, insulting, discriminatory, radical or otherwise offensive statements. Breach of these rules may result in removal of the content and termination of the account without further warning. 12. APPLICABLE LAW AND JURISDICTION These Terms and any dispute arising from your use of the site, products or services shall be governed by the laws of the country where Divine's headquarters are located. By using the site, you submit to the exclusive jurisdiction and venue of the courts located in that jurisdiction. 13. FINAL PROVISIONS This Agreement constitutes the entire agreement between Divine and the user and supersedes any prior written or oral statements. Divine is not responsible for user-generated content and does not warrant the accuracy, completeness or usefulness of any messages posted by users. Divine may remove objectionable content at its discretion and will make reasonable efforts to do so in a timely manner if removal is deemed necessary. If any provision of these Terms is held invalid, the validity of the remaining provisions is unaffected.
